  1. Purpose

These Terms of Use regulate the rights and obligations of the website owner (hereinafter referred to as ARES) and the users in relation to the access, browsing, and use of this website, without prejudice to ARES’s right to modify the website and the conditions governing its use without prior notice. In any case, browsing the website after its modification implies the user’s acceptance of the modified terms.

However, access to certain content and the use of certain services may be subject to specific conditions, which will be clearly displayed and must be expressly and priorly accepted by the users. These specific conditions may replace, supplement, or modify these Terms of Use.

For the purposes of interpreting these Terms of Use, we understand that a person becomes a user at the moment they accept the Terms of Use and the Privacy Policy displayed on the website, simply by visiting and browsing through it.

ARES is the owner or, where applicable, has the corresponding licenses for the exploitation rights of intellectual and industrial property regarding the design and programming of the Website, as well as all the content offered on it, including the platform itself, texts, photographs or illustrations, logos, trademarks, graphics, designs, interfaces, or any other information or content available through it.

The user has the right to use the content and/or services of the Website strictly for domestic purposes, during the use of the website, and solely for the purpose of enjoying the benefits of the service in accordance with these Terms of Use.

All intellectual and industrial property rights over the content and/or services of the Website are reserved, and in particular, it is prohibited to modify, copy, reproduce, publicly communicate, transform, or distribute, by any means and in any form, all or part of the content included on the Website, for public or commercial purposes, without the prior express written authorization of ARES or, where applicable, the holder of the corresponding rights.

Likewise, it is prohibited to delete or manipulate copyright indications or other credits that identify the rights holders of the content that the user finds on the Website, as well as any watermarks incorporated into the images published on this page.

If the user becomes aware of the existence of any illicit, illegal, or contrary to the law content that could constitute an infringement of intellectual and/or industrial property rights, they must immediately notify the provider through the email address info@revelia.org so that ARES can take appropriate measures.

Similarly, in the event that any user or third party believes that any of the contents of the Website owned by ARES violate their intellectual and/or industrial property rights, as well as any other rights, they must send a communication to info@revelia.org with the following information:

Identification data and contact information of the claimant or their legal representative.

Documentation proving their status as the alleged rights holder.

Detailed account of the rights allegedly infringed by ARES, as well as their exact location within the Website.

Express declaration by the claimant that the use of the content has been done without the consent of the alleged rights holder.

5.- Applicable conditions on links and other links

5.1.- Links to different websites

In the event that the Website includes links to other websites through buttons, links, banners, or embedded content, ARES informs that these are directly managed by third parties, and ARES does not have the human or technical means to know in advance and/or control and/or approve all the information, content, products, or services provided by other platforms to which links may be established from the Website.

Consequently, ARES assumes no responsibility for any aspect related to the platform or website to which a link may be established from the Website, specifically, but not limited to, its operation, access, data, information, files, quality, and reliability of its products and services, its own links, and/or any of its content, in general.

In this regard, if users have effective knowledge that the activities carried out through these third-party websites are illegal and/or contravene morality and/or public order, they must immediately notify the provider so that the access link to them can be disabled, which will be done as soon as possible.

In any case, the establishment of any type of link from the Website to another external website does not imply the existence of any kind of relationship, collaboration, or dependence between ARES and the responsible party of said external website.

5.2. Links to other platforms, responsibility of ARES

ARES provides users with links that allow them to access the channels and pages of the Website that ARES maintains on different web platforms and its own channels on social networks, owned by third parties, from which ARES publishes information and promotes events related to ARES’ social purpose.

In no case will ARES share any kind of private information of its users with these platforms. Only ARES’ own information about its products and/or services will be published. In this sense, any information that the user wishes to provide or publish on these platforms outside of ARES’ website will be under their own responsibility and subject to the specific conditions of each of these platforms. ARES does not intervene in this process.

The activation and use of these applications may require the user to identify and authenticate themselves with their username and password for this platform, as well as expressly accept the specific legal conditions associated with it, if applicable. By accessing these external networks, the user enters an environment outside of the ARES website and, therefore, under the sole responsibility of the user. 5.3 Links on other web pages leading to the ARES website

ARES does not have the human or technical means to know, control, or approve all the information, content, products, or services provided by other web pages that have established links to the website. ARES assumes no responsibility for any aspect related to the web page that establishes such a link to the website, specifically including, but not limited to, its operation, access, data, information, files, quality, and reliability of its products and services, its own links, and/or any of its content in general.

  1. Website Conditions

ARES states that it is not allowed and, therefore, the consequences will be the sole responsibility of the user, to access or use the Website for illegal or unauthorized purposes, with or without economic intent. In particular, and without the following list being absolute, the following is prohibited:

– Using the Website in a way that may cause damage, interruptions, inefficiencies, or defects in its operation or in the computer systems of any third party or, in the case of ARES;

– Using the Website for the transmission, installation, or publication of any virus, malicious code, or other harmful programs or files;

– Using the Website to collect personal data from other users;

– Using the Website illegally, against good faith, morals, and public order;

– Registering through the Website or providing a false identity, impersonating third parties, using a profile, or taking any other action that may confuse other users about the identity of the origin of a message;

– Unauthorized access to any section of the Website, to other systems or networks connected to the Website, to any ARES server, or to the services offered through the Website, through hacking or forgery, password extraction, or any other illegitimate means;

– Breaking, or attempting to break, the security or authentication measures of the Website or any network connected to it, or the security or protection measures inherent in the content offered on the Website;

– Carrying out any action that causes disproportionate or unnecessary saturation in the infrastructure of the Website or in the systems or networks of ARES, as well as in the systems and networks connected to the Website; or

– Preventing the normal development of an event, contest, promotion, or any other activity available through the Website or any of its functionalities, whether by illegally or in any other way altering, the access, participation, or operation of those, or by falsifying the results of the same and/or using fraudulent participation methods, by any procedure, and/or through any practice that violates or in any way breaches these Terms of Use.

Failure to comply with any of the above obligations by the user may result in ARES taking appropriate measures protected by law and in the exercise of its rights or obligations, which may include the deletion or blocking of the infringing user’s account, without the possibility of any compensation for damages caused.

  1. Responsibility and Guarantees

ARES cannot guarantee the reliability, usefulness, or truthfulness of all the information and/or services on the Website, nor the usefulness or truthfulness of the documentation made available through it.

Consequently, ARES does not guarantee: a) the continuity of the content on the Website; b) the absence of errors in said content; c) the invulnerability, from a security standpoint, of the Website and/or the impossibility of breaching the security measures adopted therein; d) the lack of usefulness or performance of the content on the Website; and e) the damages or harm caused, to itself or to a third party, by anyone who violates the conditions, rules, and instructions established by ARES on the Website or by breaching the Website’s security systems.

However, ARES declares that it has taken all necessary measures, within its capabilities and the state of the art, to ensure the functioning of the Website, minimize system errors, and guarantee the highest level of user security, both technically and in terms of the content published on the Website.

ARES cannot guarantee the legality, reliability, and usefulness of the content provided by third parties through the Website, guaranteeing it only with respect to the content published by ARES. If the user becomes aware of the existence of any illegal, unlawful, or content that may constitute an infringement of third-party rights, they must immediately notify the provider so that appropriate measures can be taken.

In any case, ARES reserves the right to suspend, modify, restrict, or interrupt, either temporarily or permanently, the access, browsing, use, hosting, and/or downloading of content and/or use of services of the Website, with or without prior notice, to users who contravene any of the provisions detailed in these Terms of Use, without the possibility for the user to demand any compensation for this cause.

In the event that the user breaches these Terms of Use, ARES may suspend or cancel their user account/subscription automatically and without prior notice, and in no case would such suspension or cancellation entitle the user to any compensation. For these purposes, ARES informs that it may report and cooperate promptly with the competent police and judicial authorities if it detects any violation of current legislation or if it suspects the commission of any crime.

  1. Confidentiality and Data Protection

In accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council, dated April 27, 2016, regarding the protection of individuals with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as GDPR), all personal data provided during the use of the website will be processed in accordance with the provisions of the Privacy Policy, which must be expressly and previously accepted before providing personal data by all users of the website.

  1. Applicable Legislation and Competent Jurisdiction

The parties expressly agree that this contract shall be governed by and interpreted, in all its terms and conditions, in accordance with the current Spanish legislation.

The parties expressly submit, for any issues or disputes that may arise due to the interpretation, compliance, and execution of this contract, to the jurisdiction and competence of the Courts and Tribunals corresponding to the domicile of ARES, as long as it has the status of a consumer, being subject to the domicile of ARES in all other cases.
